Assumption of Risk, Release of Liability, and Indemnity Agreement
This Agreement is entered into by and between the undersigned parent/guardian and the BENT OXEN Snowboard Team, its directors, officers, members, coaches, volunteers, employees, and agents (collectively "the Team").
Acknowledgment of Risk: The undersigned acknowledges and understands that snowboarding is an inherently dangerous sport and involves risks of serious injury, including but not limited to falls, collisions with other snowboarders or objects, and the effects of weather and snow conditions. Despite these risks, the undersigned wishes to allow the minor child to participate in the Team's activities.
Assumption of Risk: The undersigned, on behalf of themselves and the minor child, knowingly and freely assumes all such risks, both known and unknown, and assumes full responsibility for the minor child's participation in the Team's activities.
Release of Liability: The undersigned, on behalf of themselves and the minor child, and their heirs, assigns, personal representatives, and next of kin, hereby releases, indemnifies, and holds harmless the Team with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Team or otherwise, to the fullest extent permitted by law.
Indemnification: The undersigned agrees to indemnify and hold the Team harmless from any and all liabilities, claims, demands, or expenses, including attorney's fees, arising from the minor child's participation in the Team's activities or any breach of this agreement.
Acknowledgment of Policies and Rules: The undersigned acknowledges that they have read and understand the Team's policies and rules, and agree to abide by them.
Consent for Medical Treatment: In the event of an injury to the minor child, the undersigned hereby gives consent for emergency medical care deemed necessary by medical personnel.
Severability: If any provision of this Agreement is found to be unlawful or unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
This Agreement shall be binding upon the heirs, next of kin, executors, and administrators of the undersigned.
